Court upholds verdict that Apple TV’s ‘Servant’ series didn’t rip off an independent film

The United States Court of Appeals for the Ninth Circuit today upheld a verdict from early last year that cleared Apple of allegations that one of its Apple TV series, “Servant,” was a rip-off of an independent film.

The United States Court of Appeals for the Ninth Circuit today upheld a verdict from early last year that cleared Apple of allegations that one of its Apple TV series, “Servant,” was a rip-off of an independent film, reports Reuters (a subscription is required to read the article).

In January 2025 a federal jury ruled unanimously in favor of M. Night Shyamalan and Apple on Friday, ending a copyright trial that saw the defendants accused of stealing elements from an independent feature in the writing of the Apple TV+ series, “Servant.”

Shyamalan said he and his collaborators on the show didn’t steal from a 2013 independent film about a delusional mother and her baby doll. The lawsuit claimed that the Apple TV+ series “Servant” is a facsimile of Gergorini’s 2013 film, “The Truth About Emanuel.”

Now the US Court of Appeals for the Ninth Circuit has upheld the jury’s verdict in Apple’s favor.
