Evolved Wireless: hey, we don’t owe Apple millions of bucks

According to Law360, Evolved Wireless told a Delaware federal jury Wednesday that Apple used “misdirection” to try to convince jurors that the technology giant doesn’t owe millions for infringing two of Evolved’s patents related to LTE technology.

Evolved filed six separate actions in June 2015 against Apple, Samsung, and other smartphone makers, saying they infringed its five patents. According to its complaint, “Evolved Wireless owns, through assignments originating with LG Electronics, a standard-essential patent portfolio relating to LTE wireless communication systems. However, in December 2017, the Patent Trial and Appeal Board invalidated those claims.

On the other hand, in February 2019, a Delaware federal judge ruled Apple can’t escape parts of a patent suit brought by Evolved Wireless because heavily redacted copies of a licensing agreement made it impossible to determine at the current stage whether Evolved was bound by a covenant not to sue the smartphone giant over LTE technology.
