Apple accused of swiping employees from Masimo, a medical device maker

Another day, another lawsuit. Apple poached key employees from medical device maker Masimo Corp. and swiped some of the company’s trade secrets and patent-protected technology for use in the Apple Watch series of products, according to a lawsuit filed Thursday in California federal court, reports Law360 (a subscription is required to read the entire article).

Masimo is an American manufacturer of noninvasive patient monitoring technologies based in Irvine, California. The company sells more pulse oximetry to hospitals than any other company.

Masimo claims Apple pretended to have a working relationship with them, then poached some key  employees. Masimo also believes the ‌Apple Watch‌ is infringing on 10 of the company’s patents. The company seeks an injunction against Apple Watch Series 4 and Series 5, damages for patent infringement and theft of trade secrets, and court fees, among other relief. 

In other legal news, an Apple subsidiary is accused of wrongly charged customers tax on business operations software that is exempt from Illinois sales tax, a boutique fashion store has told a federal court in challenging the company’s motion to dismiss the store’s proposed class action.
